The Age 55 Rule for UK Pension Transfers - When Your Window Opens and What to Do Next

If you are a British expat living in Canada with a UK employer pension, there is one date that determines when you can act: your 55th birthday.

Under UK pension access rules, no QROPS transfer – and no access to any UK pension – can begin before you turn 55. It does not matter how long you have lived in Canada, how large your pension is, or how urgently you want to consolidate your retirement savings into Canadian dollars. The minimum age is 55, and that is a hard rule with no exceptions.

This page explains what the age-55 rule means in practice, what to do if you are not there yet, what changes at the upper end of the eligibility window at age 70, and what the April 2027 UK Inheritance Tax deadline means for those approaching 55 with a Defined Benefit pension.

What the Age 55 Rule Actually Is

The age-55 rule is the UK government’s minimum pension access age – the threshold below which no UK pension holder can access, transfer, or do anything with their pension. It was set at 55 under the UK Finance Act 2004 and applies universally, regardless of where in the world you now live.

For British expats in Canada, this means the following:

01

Before age 55

You cannot initiate a QROPS transfer. You cannot request a Cash Equivalent Transfer Value (CETV) from your UK scheme. You cannot access any pension funds under any arrangement. The door is closed.

02

Between age 55 and 70

Your QROPS eligibility window is open. This is when the transfer can happen – you hold all three required criteria (UK employer pension, Canadian permanent residency, and age within the window). This is the window Strata QROPS works within.

03

Above age 70

The QROPS transfer structure into a Canadian RRSP changes significantly. Canadian rules require RRSP conversion to a RRIF by December 31 of the year you turn 71 – meaning a transfer received after age 70 would face immediate conversion, significantly complicating the structure. Simon Huften assesses each case individually for clients approaching this boundary.

One important note: the age-55 rule applies to the person initiating the transfer. Your spouse’s age does not affect your eligibility, and vice versa. Each pension holder is assessed individually.

Planning Note for 2026: The UK government has legislated a rise in the minimum pension access age from 55 to 57, effective April 6, 2028 (Finance Act 2022). The current operative minimum is 55 – this has not changed. But if you are currently aged 55 or 56, your transfer window is open now under the current rules. Anyone who has not yet initiated a transfer before April 2028 will need to wait until age 57. If you are 55 or 56 today, this is an additional reason to act – not a reason to wait. Simon Huften will confirm how the 2028 change applies to your specific timeline during your consultation.

If You Are Under 55: How to Use This Time Productively

You cannot initiate a QROPS transfer before your 55th birthday. That is the rule and there is no workaround. But the time between now and your 55th birthday is not wasted – it is when the most prepared British expats build the groundwork that allows them to complete their transfer within weeks of becoming eligible.

Here is exactly what to do before you turn 55:

01

Locate and Confirm Your Pension Type

The single most valuable thing you can do before 55 is confirm what type of UK pension you hold. Dig out your most recent pension statement. Look for these phrases:

  • “Final salary” or “career average”: You have a Defined Benefit (DB) pension. The transfer process is longer (12–16 weeks) and requires independent financial advice from an FCA-regulated UK advisor. Knowing this now means you can start researching that stage in advance.
  • “Pot value,” “fund value,” or “money purchase”: You have a Defined Contribution (DC) pension. The process is simpler and faster (6–8 weeks). No FCA advice required in most cases.
  • Not sure: Bring your pension statement to your free preliminary consultation with Simon Huften. He identifies the pension type within minutes.

02

Gather Your UK Pension Scheme Details

You will need the following when the transfer begins – gathering it now means no delays on your 55th birthday:

  • Your pension scheme name and employer name
  • Your National Insurance number
  • Your most recent pension statement (or the scheme’s online portal login)
  • Contact details for your scheme’s member services or transfer team

03

Book a Preliminary Consultation With Simon Huften

Simon Huften takes preliminary consultations with under-55 British expats – not to initiate a transfer, but to give you a clear picture of your specific situation before you are eligible. In 20 minutes, he will confirm your pension type, give you a realistic transfer value estimate, explain the timeline you should expect, and flag anything that could complicate your transfer so you can address it in advance. Many clients who come to Simon at 55 ready to transfer immediately had a preliminary call two or three years earlier.

04

Understand the April 2027 UK Inheritance Tax Deadline

From April 2027, UK pension death benefits will be included in your estate for Inheritance Tax – potentially taxed at 40%. If you hold a Defined Benefit pension and will turn 55 before April 2027, this deadline is directly relevant to you: a QROPS transfer removes your pension from the UK IHT regime entirely.

If you will turn 55 after April 2027, the IHT change will already have taken effect by the time your transfer window opens. That does not make a QROPS transfer less valuable – but the urgency calculus is different. Simon will explain how the 2027 change affects your specific situation during your preliminary consultation.

If You Are Between 55 and 70: Your Eligibility Window Is Open Now

If you have passed your 55th birthday and have not yet reached 70, your QROPS transfer window is open. You meet the age criterion. Combined with a UK employer pension and permanent Canadian residency, you are eligible to begin. The only remaining question is whether you have started.

Here is what your transfer timeline looks like from today, depending on your pension type:

Your Pension Type

Timeline

FCA Advice?

April 2027 IHT Status

Defined Contribution (DC) Money purchase, workplace, auto-enrolment

6–8 weeks

No – in most cases

Comfortable window – ample time remaining

Defined Benefit (DB) – CETV under £30,000

8–12 weeks

No

Achievable before April 2027 – begin now

Defined Benefit (DB) – CETV over £30,000

12–16 weeks

Yes – Simon coordinates the FCA referral

Window is closing. DB pension holders should start immediately.

Every week of delay for a Defined Benefit pension holder is a week closer to the April 2027 IHT deadline with a 12–16 week process still ahead of them. If you are between 55 and 70 and hold a Defined Benefit pension, the time to act is now.

What About Age 70 – Is There an Upper Limit?

The practical upper boundary for a standard QROPS transfer into a Canadian RRSP is age 70. Here is why that number matters: Canadian tax rules require RRSP holders to convert their RRSP into a Registered Retirement Income Fund (RRIF) by December 31 of the year they turn 71. A QROPS transfer into an RRSP received after age 70 would face immediate conversion – significantly complicating the transfer structure. Simon Huften’s working threshold of 70 exists to protect your transfer from that timing risk.

If you are approaching 70, this makes the timing of your transfer more – not less – important. Simon Huften works with clients in this age group and assesses the timeline carefully to ensure the transfer completes within the available window. Contact us immediately if you are between 68 and 70 – the earlier you start, the more options you have.

“I kept putting it off and ended up calling Simon at 64. I thought I’d left it too late and made it more complicated than it needed to be. He had the whole process running within a week of our first call. Completed in 14 weeks.”

– Thomas E., Alberta | Defined Benefit Transfer, 2024

What You Can Do on Your 55th Birthday

The day you turn 55, the following become available to you for the first time:

The transfer does not happen on your birthday – but the process can begin on that day. British expats who have prepared in advance (pension documents gathered, Simon briefed, scheme details confirmed) have initiated their transfers within days of turning 55.

Frequently Asked Questions

Can I do anything with my UK pension before I turn 55?

No. Before your 55th birthday, you cannot access, transfer, or initiate any action on a UK pension. No CETV can be requested, no QROPS transfer can begin, and no pension income can be taken. The minimum pension access age of 55 is a hard UK legislative rule with no exceptions – it applies equally to British expats living abroad as it does to UK residents. What you can do before 55 is prepare: gather your pension documents, confirm your scheme details, and book a preliminary consultation with Simon Huften so that you are ready to move immediately on your birthday.

It is not too late – provided you are still under 70 and your pension remains intact in your UK scheme. Every day that passes is a day of unnecessary currency risk and, for those with Defined Benefit pensions, a day closer to the April 2027 UK Inheritance Tax deadline. But the transfer remains available to you today. Book a consultation with Simon Huften and the process can begin immediately. There is no penalty for starting late – the only cost is the time you have already waited.

Yes – provided the transfer can be completed before December 31 of the year you turn 71, when Canadian rules require your RRSP to convert to a RRIF. At age 69, the standard transfer timeline of 6–16 weeks (depending on pension type) fits comfortably within that window. Contact Simon Huften immediately so he can assess your specific timeline and ensure your transfer completes before the RRSP conversion deadline. This is a situation where acting quickly is important.

They are different rules addressing different things. The age 55 rule is about when you can access your UK pension at all – it applies to everyone, regardless of QROPS. The QROPS 5-year rule was a provision designed to prevent UK residents from temporarily relocating to another country to transfer their pension and then returning to the UK for a tax advantage. For genuine, long-term Canadian permanent residents, the 5-year rule is not a barrier to transfer. Simon Huften confirms your residency position during your initial consultation.

No – a scheme closure or employer insolvency does not override the age-55 minimum access rule. If your DB scheme is closing, the scheme trustees will manage the winding-up process and preserve your accrued benefits until you reach 55. At that point, a QROPS transfer becomes possible. Some schemes facing closure will offer enhanced transfer values or early access in exceptional circumstances – this is a specialist area and Simon Huften can advise on your specific situation during a consultation.
